On May 19, the Virginian’s Bristol attorney informed him that a routine Westlaw search of the Godley title had uncovered 1992 and 1993 opinions, from the Federal District Court in Pikeville, Kentucky, and the Sixth Circuit Court of Appeals in Ohio, holding the title null and void and that Godley had been a party in the action and the Wades had represented her. The news shocked the Virginian and he asked the attorney to double-check the opinions language and legal impact on the title. The Virginian passed the information on to Middleton who was also incredulous.
